The Convention on Biological Diversity, adopted at the Earth Summit in Rio in 1992, enshrines the principle of ABS in its Article 15, and the fair and equitable sharing of benefits arising from the utilization of knowledge, innovations and practices of indigenous and local communities relevant for the conservation and sustainable use of biological diversity in its Article 8-j.

The Nagoya Protocol was adopted by the Conference of States Parties to the Convention on Biological Diversity meeting in Nagoya in 2010 to implement ABS in a transparent and legally secure framework for both provider and user countries.
